ASYLUM/REFUGEE & ACCESS TO JUSTICE is an initiative and one the thematic areas of the CYID Mixed Migration Support Working Group meant to help understand the complexity of “vulnerable migrants in need of protection assistance” and state obligations in their protection. The group will further promote access to justice for all migrants, gain awareness of the situation of other categories of vulnerable migrants in need of protection assistance, with particular focus on the special case of asylum seekers and refugees.
Considerable attention is devoted to asylum-seekers and refugees in mixed flows due to the established international legal principles of non-refoulement and refugee protection. They are still subjected to violence (including gender-based violence) and psychological distress and trauma during the migration process. Vulnerable individuals such as pregnant women, children and the elderly, stranded migrants, stateless persons, refugees, and asylum seekers among mixed migration flows are particularly susceptible.
